End User License Agreement.
1. Acknowledgement and relationship to Apple
When you download or use the Licensed Application on macOS, iOS or iPadOS through Apple Inc. (“Apple”) or the Apple App Store, you and Imagine That AI LLC acknowledge that this EULA is concluded between you and Imagine That AI LLC only, and not with Apple. Imagine That AI LLC, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA incorporates our Terms of Service and Privacy Policy; if any term of the Terms of Service conflicts with Apple’s Minimum Terms for Developer End-User License Agreements, the Apple Minimum Terms in this EULA control for App Store copies of the Licensed Application.
2. Scope of license
Subject to your compliance with this EULA and the Terms of Service, Imagine That AI LLC grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and run the Licensed Application on Apple-branded products (and, for non-App-Store installers downloaded from fromafar.app, on personal Windows or Linux computers) that you own or hold explicit authorization to control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Personal Afar tiers (Free, Afar BYO-Network, Afar Solo and Afar Pro Fleet) are licensed to one human operator. Apple Family Sharing is disabled for Afar remote-access and relay subscriptions. You may not distribute, rent, lease, lend, sell, reverse engineer, decompile or attempt to extract source code from the Licensed Application except to the extent such restriction is prohibited by applicable law or permitted by the license of an open-source component listed on /acknowledgements.
3. Authorized personal computers only
The Licensed Application connects to your own Mac desktop, PTY terminal and workspace files (or another computer whose lawful owner and, where applicable, employer or administrator has given you explicit written permission). It does not rent cloud virtual machines in consumer tiers, and you may never use it to view or control a computer without permission.
4. Auto-renewing subscription terms (App Store Guideline 3.1.2)
Reaching 1 Mac from 1 viewer on same-subnet home Wi-Fi (Home & Couch Mode) is free forever and requires no subscription. Optional auto-renewing subscriptions offered when billing opens are:
- Afar BYO-Network: $49 per year (remote
trustedProxyHostsover your own Tailscale, VPN or HTTPS; up to 3 Macs and unlimited viewers; 0 GB managed relay). - Afar Solo: $15 per month or $119 per year (up to 3 Macs, 10 viewers, 2 concurrent streams, 20 GB per month hard-stopped managed relay, and native push notifications).
- Afar Pro Fleet: $29 per month or $249 per year on Web and US iOS ($259 per year on International iOS) (up to 8 Macs, 25 viewers, 4 concurrent streams, 60 GB per month hard-stopped managed relay, native push, and 1 opt-in verified unanswered-prompt pager contact).
When subscribed through Apple In-App Purchase: (a) payment will be charged to your Apple ID account at confirmation of purchase, or at the end of any 14-day free trial if not cancelled at least 24 hours before the trial expires; (b) your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period; (c) your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the price of your selected plan; (d) you can manage your subscriptions and turn off auto-renewal after purchase in your Apple ID Account Settings; and (e) any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription to that publication, where applicable. 5. Maintenance and support
Imagine That AI LLC is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA and the Terms of Service, or as required under applicable law. You and Imagine That AI LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
6. Warranty and App Store refund procedure
Imagine That AI LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in the Terms of Service. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Imagine That AI LLC’s sole responsibility, subject to the disclaimers and liability caps in the Terms of Service.
7. Product claims
You and Imagine That AI LLC acknowledge that Imagine That AI LLC, not Apple, is responsible for addressing any claims of yours or of any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
8. Intellectual property rights
You and Imagine That AI LLC acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party’s intellectual property rights, Imagine That AI LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by the Terms of Service.
9. Legal and export compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
10. Third-party terms of agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless carrier data service agreement, home broadband agreement or Tailscale network service agreement).
11. Third-party beneficiary
You and Imagine That AI LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
